Fact Sheet: Eviction

State law covers the eviction process, so where you live will influence how it is done.  Here is some general information about evictions:

TERMINATION WITH CAUSE

Pay Rent or Quit Notice: This is a notice presented to you when you do not pay the rent.  You are usually given 3-5 days to become current with rent payments or told to move out.

Cure or Quit Notice: This notice is given when you have broken one or more of the clauses of your lease or rental agreement.  You are given the choice to fix what you are doing wrong or move out.

Unconditional Quit Notice: If you are repeatedly late with the rent, are breaking rules over and over, or are committing crimes on the property, your landlord might not give you a change the rectify the situation and instead orders you to move out.

TERMINATION WITHOUT CAUSE

30-/60-Day Notice to Vacate: If you do not have a fixed lease your landlord need only give you sufficient warning before asking you to move out.

Lawsuit: If you have not moved out in the time requested the landlord must then serve you with an official summons of eviction and you will go to court.

Sheriff's Escort: If you lose your claim in court you will receive a notice from the sheriff's office that the sheriff will arrive on a certain date to escort you and your belongings off the property.
